Hmmm … I am sure there could be a solution with countermeasures, so that a pure battle build would not invest into countermeasures as much as a trader (for example, make it a Weapon instead a Utility). But that would require quite a lot of balancing and re-balancing, so that will probably never happen.

As far as I know, mines will still damage shields if they can actually hit. I haven't tried it in elite yet, but in another space sim I used to play mines became a pretty effective punishment against jousters if you learned to dump one right before the cross.

Now I'm trying four small missile launchers on my BB runner asp.
Two medium bursts for shields and four seekers right to the face.
