A) What jurisdiction are you in
B) What jurisdiction would you file in
C) Are you aware that the UK has strict laws on distance selling at this would be a prima facie case for summary dismissal. Thus filing in alternative places would be harder to prove any case.

On the legal issues;
The constant connection issue is a valid refund point, if you cannot use the game due to the change in the games modus operandi to an always online requirement then the is valid grounds for refund, which is what FD have been doing (originally they got it wrong and had to change their stance on it). Thus accordingly if you communicate your situation to FD they should give a full refund.
However;
Buying in to a game prior to its release is a certain amount of "on faith", and is viewed by most legal courts as an investment with its accompanying risks.
To threaten legal action over such issues only goes to show that the laymans understanding of legal principles is not normally that close to the jurisprudence that actually enforced in law.

Anyway, please answer A & B :D

As for the game, its the same for all games, some people like them, others dont.

I haven't really thought about it yet. When FD offered a 70 pounds refund, I rebutled for a full refund and that I would gladly stay involved in E: D if they could promise an Offline version somewhere down the line, now matter how "watered down and empty" it might be.
This was some time ago now, and I haven't heard back from them since.

I think you'll find that most of those complaining are emotionally invested in this game. It's not just another game. Many of us have been dreaming about this game for 30 odd years.

I still have a vain childish hope that FD will release a newsletter saying "HOLY CRAP, WE JUST REALIZED WHAT A MAJOUR CLUSTER FUCK WE JUST DID TO OUR LOYAL COMMUNITY. WE WILL OF COURSE BE DELIVERING A FULLY OFFLINE MODE AS SOON AS POSSIBLE, AS WE PROMISED IN THE KICKSTARTER. SORRY, SORRY, SORRY. PLEASE FORGIVE OUR ARROGANCE.

A little christmas tear would roll down my cheek, and all would be instantly forgiven.

But I'm a big boy now, and things are looking bloody hopeless.

So, to answer your question. If and when I get my full refund, I will happily forget about E: D and go play some of all the other great games out there.
I would probably pick up E:D for a tenner a few years from now, if the servers stay on for that long... :)

I dreamed for this elite for 22 years. I'm happy with it. I'm just tired is all. I just want everybody to be happy.

I would have used different words ;) , but I agree with GlobusDiablo here. This thread is about a subject that is very important to some, and totally unimportant to others. I took part in the conversation at the beginning, but after I went into the acceptance phase, I just kept out of it, as there is nothing I can contribute anymore.

Those, who are invested in this are welcome to continue discussing the topic here in a polite and reasonable manner.
Those, who have no interest in the topic anymore, can express this by not taking part. ;)

Like some I was somewhat disheartened to read the rather slyly slipped in a news letter lack of an offline mode/version of the game, not because I have a bad connection - quite the opposite - and not because of the DRM issues - I never intended to steal it I have already paid :P; but because of the lack of ownership and control. I still have an Atari St with it's version of E2:Fontier which I can fire up anytime and play and enjoy until I break the machine.

Can the same be said here?

With the ED being the game it is now, which IMO is less of a game then E2 was, albeit with great visuals, sound and a fantastic flight control system, I fear a little for release sales. I enjoy the game as is and have some faith FD will add and improve it however my sons who are in their 20's wouldn't and won't touch it. Now if sales are low what's the prognosis on server longevity?

Ok, that aside I have settled into agreeing that Online is the way to go, for me - hence joining this group - I would love this persistent evolving universe to really take off. I mean for instance - I want to explore away from the core systems and find wonders, Earth like planets, resource rich belts etc. and be able to place landing pads on planets then bring back the data to a faction. Which would generate faction missions and NPC activity to take raw mats out there and build stations etc. with opposing faction perhaps getting in the way.

Edit: Then again there's no technical reason that couldn't happen offline with AI NPC's is there?

Anyway just a ramble.
